The appeal challenged a conviction for culpable homicide not amounting to murder arising from a May 2007 altercation over the placement of a thatched structure on a neighbour’s wall. The victim died the following day from injuries sustained in the assault. The court modified the conviction from Section 304 to Section 304 Part II IPC and granted the appellant probation under Section 4 of the Probation of Offenders Act, 1958, requiring execution of bonds for good behaviour. The court held that beneficial probation legislation carries mandatory applicability and courts must document specific reasons for non-application.

Key Legal Principle: Even in cases of culpable homicide, the Probation of Offenders Act may apply where the offender is a first-time convict and a significant period (here, 18 years) has elapsed. Courts must provide recorded reasons if they choose not to extend probation benefits.

The petitioner sought compassionate appointment following the death of his father, who was employed as a Head Master at a school receiving grants from the Social Welfare Department. The respondent authorities had denied the application on the ground that the Dying in Harness Rules did not apply to aided institutions. The court, relying on the precedent in Ram Singh and the Government Order dated 04.06.2019 that provides an exception for grant-aided institutions, directed the petitioner to submit a fresh representation to the Director of Social Welfare Department, which was to be decided within four weeks.
